Public Consultation on General Comment No XX on the African Charter on Human and Peoples’ Rights: The Right to Freedom of Movement and Residence (Article 12(1))


The Special Rapporteur on Refugees, Asylum Seekers, Internally Displaced Persons and Migrants in Africa, Honorable Commissioner Maya Sahli Fadel in carrying out his mandate as defined by Resolution ACHPR / Res.72 (XXXV1) 04 was investigated by the African Commission on Human and Peoples' Rights following the adoption of Resolution ACHPR / Res. 407 (LXII) 2018, to prepare a general comment to clarify the obligations incumbent on States parties to the African Charter under Article 12 (1) on the right to freedom of movement and to freely choose residence within a state.

The General Observation Project was developed as a result of a series of expert meetings and is currently undergoing a consultation process.

As part of the consultative process, the Special Rapporteur invites all stakeholders to send their contributions on the general comment to the African Commission before the close of business on Monday 21 January 2019.
