Recommendations of the Sensitisation Seminar for Member States of the African Union on the Ratification of the Protocol on the Rights of Older Persons in Africa and the Protocol on the Rights of Persons with Disabilities in Africa

    Meeting on 5 and 6 July 2019 at Radisson Blu Hotel & Convention Centre in Kigali, Rwanda,  on the initiative of the African Commission on Human and Peoples’ Rights through its Working Group on the Rights of Older Persons and People with Disabilities in Africa, and in collaboration with the Republic of Rwanda; the participants at the Sensitisation Seminar for Member States of the African Union on the Ratification of the Protocol on the Rights of Older Persons in Africa and the Protocol on the Rights of Persons with Disabilities in Africa;

    Conscious of the deteriorating situation of the rights of older persons and persons with disabilities in Africa;

    Noting the non-entry into force of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa despite its adoption by the African Union in January 2016, and the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Persons with Disabilities in Africa adopted by the African Union in January 2018;

    Recalling the various Decisions of the Executive Council of the African Union calling on Member States to ratify without delay the Treaties of the African Union, including the two abovementioned Protocols;

    Welcoming the signing of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa by Benin, Chad, Comoros, Ghana, Guinea, Lesotho, Mali, Mozambique, Sierra Leone, Togo and Zambia;

    Welcoming the ratification of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa by Lesotho;

    Welcoming the signing of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Persons with Disabilities in Africa by Burkina Faso, Central African Republic, South Africa and Togo;

    Encouraged by the many and varied ongoing initiatives and processes in some Member States aimed at becoming parties to these two Protocols; and

    Bearing in mind the shared African values contained in the two Protocols through the positive and necessary guarantees and measures in favour of older persons and persons with disabilities;

    Recommend that:

    1.     States parties to the African Charter on Human and Peoples’ Rights should sign and ratify the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa and the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Persons with Disabilities in Africa;

    2.     National Human Rights Institutions (NHRIs) should encourage their States to become parties to the two Protocols; and

    3.     Civil society organisations and actors should continue and increase their advocacy efforts towards the ratification by all Member States of the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Older Persons in Africa and the Protocol to the African Charter on Human and Peoples’ Rights on the Rights of Persons with Disabilities in Africa.
